When Did Cannabis Become Legal in New Jersey

New Jersey voters approved recreational cannabis through a public referendum on November 3, 2020. More than two thirds of voters said yes to legalising adult use cannabis.

Governor Phil Murphy signed the New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act into law on February 22, 2021.

Licensed dispensaries began selling recreational cannabis to adults on April 21, 2022. The state now operates hundreds of licensed cannabis retailers, cultivators, and delivery services under the New Jersey Cannabis Regulatory Commission (NJ CRC).

The New Jersey Cannabis Regulatory Commission is the official state body overseeing all cannabis licensing, compliance, and regulation in New Jersey.

Who Can Buy Cannabis in New Jersey

The rules are straightforward:

  • You must be 21 years of age or older.
  • You must have a valid government-issued photo ID. This includes a drivers license, state ID card, or passport.
  • Dispensaries are required by law to check IDs before every sale.
  • No medical card is required to purchase recreational cannabis.

How Much Cannabis Can You Legally Have

Under NJ law, adults 21 and older can legally possess:

  • Up to 6 ounces of cannabis flower
  • Up to 17 grams of cannabis concentrates such as wax, shatter, or live resin
  • Up to 1,000mg of THC in edible or liquid form

These limits apply in public spaces. There is no defined legal limit within a private residence, though exceeding public possession limits can result in civil or criminal penalties depending on the amount.

Where Can You Consume Cannabis in NJ

This is where many people get confused. Here it is clearly:

  • You CAN consume cannabis inside a private residence.
  • You CANNOT consume cannabis in public spaces including streets, parks, parking lots, or sidewalks.
  • You CANNOT consume cannabis in a motor vehicle whether as a driver or a passenger.
  • You CANNOT consume cannabis at a place of employment unless the employer expressly permits it.

Employers in New Jersey retain the right to maintain drug-free workplace policies and can prohibit cannabis use during work hours.

Can You Grow Cannabis at Home in New Jersey

No. Unlike some other legal states, New Jersey does not permit home cultivation. You cannot grow cannabis plants at home regardless of the intended quantity.

All cannabis in New Jersey must come from a licensed cultivator and be sold through a licensed retailer or delivery service.
